Atmospheric Adventures, through atmosphericadventures.com, is the online store owned and operated by Atmospheric Adventures LLC, a limited liability company under the laws of the state of Florida, USA (“Atmospheric Adventures”). Atmospheric Adventures may change or update the below terms and conditions, as well as policies and notices at any time and without notice.

1.0 FPV Rules and Regulations

The operation and use of FPV radio equipment (such as UHF long range systems or video transmission equipment) in the USA and other countries may require a license, and some countries may forbid its use entirely. Within the United States, you will need a “HAM” amateur radio license. It is your responsibility to ensure that the use of products you purchase from Atmospheric Adventures meet the requirements enforced by your government’s rules and regulations for RF devices. Do not purchase products from Atmospheric Adventures if you are unsure of the government requirements, or if you are unable to comply with them. Atmospheric Adventures will not be held responsible for your actions under and circumstance, including but not limited to if you use products purchased from Atmospheric Adventures in violation of your government’s regulations. Atmospheric Adventures sells products with no claim for suitability or legality of operation whatsoever.

2.0 Warning Notice

You acknowledge that you fully understand the inherent dangers involved when operating multi-rotor, and other model aircraft or vehicles. Spinning propellers can cause significant injury. Never work on your models while the propellers are mounted. Lithium Polymer (LiPo) batteries can become unstable if not used or charged correctly – this can include combustion or spontaneously catching fire. Power systems including motors, batteries, and electronic speed control (ESC) units can draw significant current, in some cases over 30 amps, which can be hazardous. You can prevent electrical shock by always working with safely de-energized powered electronic systems. Never short the electrical leads, never reverse the electrical leads, and never place the electrical leads on your body at any time.

3.0 No Warranty/Liability

Atmospheric Adventures does not provide any warranty of any kind for any of the equipment it sells or otherwise distributes. You assume any and all risks for any of the products purchased or received from Atmospheric Adventures, or its employees. Atmospheric Adventures, or its employees are not liable for any instance of injury to you or others, or damage and destruction of property. In addition, Atmospheric Adventures is not liable for any damages, consequential or inconsequential, resulting from the use or application of any Atmospheric Adventures provided products. Atmospheric Adventures sells equipment expressly without warranty or performance for any use or situation. It is the responsibility of the user to properly ensure that the products safely meet the user’s intended purpose.

3.1 Faulty Items

If an item that you purchased and received from Atmospheric Adventures is believed to be faulty or inoperable (“Faulty Item”) due to a manufacturing defect, then Atmospheric Adventures may replace or repair that specific item at its sole discretion if the item is deemed by Atmospheric Adventures to be faulty due to a manufacturing defect, and not misused by the user including construction error. Atmospheric Adventures will not be liable for any equipment that might have been damaged and/or lost as a result of the Faulty Item. For example, if a video transmitter you have purchased from Atmospheric Adventures is faulty and stops working during flight resulting in the loss of your airframe, Atmospheric Adventures may replace the faulty video transmitter, but will not replace any other equipment that may have been lost and/or damaged due to the faulty video transmitter.

3.2 Incorrectly Published Product Details

Atmospheric Adventures makes every attempt to provide accurate information on our website. Atmospheric Adventures is not liable for any issues that may result from incorrect product details published on the Atmospheric Adventures website. Please be aware that specifications and prices may change without notice. If you require confirmation of specifications, pricing, or availability – please contact Atmospheric Adventures customer service directly.

4.0 Shipping Terms and Conditions:

4.1 Commercial Carriers

You accept USPS, UPS, and all other commercial carriers Atmospheric Adventures offers or chooses to fulfil your order (“Mail Carrier(s)”) as reliable mail carriers and Atmospheric Adventures carriers of choice.

4.2 Shipping Address

We require complete and valid street addresses to ship your package. We will not ship orders to the following:

1.We will not ship orders to Freight Forwarding Addresses. We ship internationally to just about any country in the world.

  • Hotels and Convention Center Addresses – Problems with packages being lost could occur at these locations. We require full permanent, verified, residential or established business addresses.
  • PO Box and APO addresses – These addresses are reviewed on a case by case basis, and may be declined. To avoid this review process, please use regular residential or business addresses.
  • COD – Atmospheric Adventures will not ship Cash On Delivery. All products must be prepaid.
  • Export Compliance – Atmospheric Adventures strives to comply fully to all laws of the USA including embargo to exports to named countries, companies, and individuals.

4.3 Tracking and Lost Shipments

If you are eligible for “Free Shipping”, Atmospheric Adventures will ship your package with the United States Postal Service (“USPS”). Depending on the USPS service chosen by Atmospheric Adventures, the shipment may show that it has been received by the USPS, but may not show any tracking information after it was received by the USPS. Even mail services that normally provide full tracking information to your location will sometimes not show any information after the USPS receives the package. Atmospheric Adventures has no control or influence over the internal processes of Mail Carriers or the local postal system in your country. Atmospheric Adventures will not be held liable for any mistakes made by a Mail Carrier or your local country’s postal service.

If the tracking information for your shipment shows that your package has been received by any of Atmospheric Adventures mail carriers, Atmospheric Adventures is not responsible if your package is never delivered to your location. There will be no refunds if your package is lost in the mail system either in the USA or in your destination country. Almost all packages sent by Atmospheric Adventures are delivered to the customer. Please contact the Mail Carrier directly if there is a shipping issue or claim.

4.4 Shipping Insurance

When Atmospheric Adventures ships your order with any Mail Carrier, the delivery will not be “insured”.

4.5 Signature Requirements

Atmospheric Adventures does not offer any mail services that require a signature for your package upon delivery. A signature may be required in certain cases only, and at Atmospheric Adventures sole discretion.

4.6 Customs, Duties, and Return to Sender Packages

International customers are solely responsible for any and all import duties your local customs office may place on your shipment. If your package is returned to Atmospheric Adventures because the Mail Carrier is unable to collect customs duties, or deliver the shipment to the address you provided, Atmospheric Adventures will not refund: A) The shipping cost from Atmospheric Adventures to your location, B) The cost of returning the shipment back to Atmospheric Adventures, when and if the shipment is returned to Atmospheric Adventures. If the shipment cannot be delivered because of the issues listed in this paragraph, and the overall value of the order is less than the cost of returning the shipment back to Atmospheric Adventures, Atmospheric Adventures may elect to abandon the shipment. If your shipment is abandoned, a refund will not be issued to you.

4.7 Backordered Items

If you order contains “backordered” items, the entire order will be held until the backordered items have come in stock. Atmospheric Adventures ships all order complete. Shipping your order partially complete will only be available under certain conditions, and in the sole discretion of Atmospheric Adventures. In stock items on the same order as backordered items will be held in reserve so that no previously purchased items run out of stock while we wait for the backordered items to arrive.

4.8 Cancelled Order Refunds

All orders declined by Atmospheric Adventures because of A) violation of our shipping rules, or B) suspected fraud, will be automatically voided with your payment method and cancelled. In most cases, you will be notified if your order has been cancelled.

4.9 Shipment Times and Delays

Atmospheric Adventures usually ships orders at least 1 business from the time the order is placed. Expedited forms of shipping such as “Next Day” are calculated from the time that Atmospheric Adventures Mail Carrier picks them up from our facility after processing. In rare cases, depending on your ship to address, it can take much longer than estimated for a shipment to deliver, and independent of the mail service chosen during check-out. The provided transit and delivery times are averages for most mail services. Atmospheric Adventures will not be responsible if a Mail Carrier, or the local post office in your country delays the transit time or delivery of your package due to customs holdings or other issues. Atmospheric Adventures will not provide refunds in the case of your shipment being delayed
